Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Speaking Lab Pro (“we,” “us,” or “the Service”). By creating an account or using the Service, you agree to these Terms. If you’re using the Service on behalf of a school, program, or other organization, you’re agreeing on its behalf as well as your own, and confirming you have the authority to do so.

What the Service is

Speaking Lab Pro is an independent TOEFL Speaking diagnostic and practice tool. It measures pace, pausing, pronunciation, grammar, and content from your recorded responses and generates practice drills based on the result. Scores, band estimates, and feedback produced by the Service are diagnostic estimates intended to guide practice — they are not official TOEFL scores, are not produced by ETS, and are not a guarantee of your performance on the actual exam.

Speaking Lab Pro is not affiliated with, endorsed by, or sponsored by the Educational Testing Service (ETS). TOEFL is a registered trademark of ETS, used here only to describe the exam this Service helps you prepare for.

Accounts and eligibility

• You’re responsible for keeping your password confidential and for all activity under your account.
• Accounts are personal to you and may not be shared or transferred.
• Information you give us when registering (name, contact details) should be accurate.
• If your account was created through a school or instructor using an access code, that organization may set additional terms for your participation, and may review your results as part of their program.

Acceptable use

You agree not to:

• Use the Service to impersonate someone else or misrepresent your identity to an examiner, school, or employer.
• Attempt to copy, scrape, redistribute, or resell the Service’s practice content or question sets.
• Interfere with the Service’s operation, attempt to bypass access controls, or probe it for vulnerabilities without authorization.
• Upload recordings or content that is unlawful, abusive, or that you don’t have the right to submit.

Your recordings and content

You retain ownership of the recordings you submit. By submitting a recording, you grant Speaking Lab Pro a limited license to store, transcribe, analyze, and display it back to you (and, where applicable, to the instructor or institution you’re enrolled under) solely to provide the Service. We don’t use your recordings for advertising or sell them to third parties — see our Privacy Policy for the full detail on how recordings are handled.

The practice questions, rubrics, drills, and other instructional content on the Service are owned by Speaking Lab Pro and licensed to you for personal, non-commercial exam preparation only.

Payment and access

The Pro Pass is a one-time purchase, not a recurring subscription: you pay $49 once and get 1 month of full access starting immediately. It does not renew or charge you again automatically. If you want continued access after it expires, you purchase another pass.

If you’re not satisfied, contact us within 7 days of purchase for a full refund. Pricing, access length, and any other terms shown to you at checkout control over any general description elsewhere on the site.

Disclaimers

The Service is provided “as is.” Diagnostic scores are estimates based on an automated and instructor-calibrated model, not a certification of your official TOEFL outcome, and we make no guarantee that practicing with the Service will result in any particular score on the actual exam. We don’t warrant that the Service will be uninterrupted, error-free, or available at all times.

Limitation of liability

To the maximum extent permitted by law, Speaking Lab Pro is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including exam outcomes, admissions decisions, or other results you attribute to your preparation. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate accounts that violate these Terms, or that we reasonably believe pose a security or legal risk to the Service or other users.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the effective date above and, where appropriate, notify account holders directly. Continued use of the Service after a change takes effect means you accept the updated Terms.
